Apart from different schedules, there are some definitions mentioned in the study of jurisprudence of pharmacy. It is very necessary to know these definition by which it'll be cleared to us in which category these drugs belong.
Misbranded Drugs: A drug is called misbranded due to several factors:
1. if it is so colored, coated, powdered or polished that damage is concealed or if it is made to appear of better or greater therapeutic value that it really is;
2. if it is not labelled in the prescribed manner; or 3. if it purports to be the product of a manufacture of whom, it is not truly a product.
Misbranded Cosmetics: A cosmetic is deemed to be misbranded: 1. if it contains a color which is not prescribed; or 2. if it is not labelled in the prescribed manner; or 3. if the label or container or anything accompanying the cosmetic bears any statement which is false or misleading in any particular.
Spurious Cosmetics: A cosmetic is deemed to be spurious: 1. if it is imported under a name which belongs to another cosmetic; or
2. if it is an imitation of, or is substitute for, another cosmetic or resembles another cosmetic in a manner likely to deceive or bears upon it or upon its label or container the name of another cosmetic, unless it is plainly and conspicuosly marked so as to reveal its true character and its lack of identity with such other cosmetics; 3. if the label or container bears the name of an individual or a company purporting to be the manufacture of the cosmetic, which individual or company is fictitious or does not exist;
4. if it purports to be the product of a manufacture of whom it is not truly a product;
Adulterated Drugs: A drug is deemed to be adulterated:
1. if it consists, in whole part, of any filthy, putrid or decomposed substance; or
2. if it has been prepared, packed or stored under insanitary conditions whereby it may have been rendered injurious to health; or
3. if it has been prepared, in whole or in part, of any poisonous or deleterious substance which may render the contents injurious to health; or
4. if it bears or contains for purposes of colouring only, a color other than one which is prescribed; or
5. if it contains any harmful or toxic substance which may render it injurious to health; or
6. if any substance has been mixed therewith so as to reduce its quality or strenghth.
